2. Rights of data subjects

You have the right:

  • to request information about your personal data processed by us in accordance with Art. 15 DSGVO.
    If we process your data, you may in particular request information on the purposes of the processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, in particular in the case of recipients in third countries, the planned storage period or the criteria for determining it, the existence of a right of rectification, erasure, restriction of processing or opposition, the existence of a right of appeal to a supervisory authority, the origin of your data, if not collected by us, as well as the existence of automated decision making including profiling and, where applicable, meaningful information on the details thereof;
  • In accordance with Art. 16 DSGVO, to demand the correction of incorrect or incomplete personal data stored by us without delay;
  • In accordance to Art. 17 DSGVO to demand the deletion of your personal data stored with us, unless the processing is necessary in particular to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • In accordance to Art. 18 DSGVO, to demand the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it and we no longer require the data, but you require it for the assertion, exercise or defence of legal claims or you have lodged an objection to the processing pursuant to Art. 21 DSGVO and it has not yet been established whether our justified reasons outweigh your interests;
  • In accordance with Art. 20 DSGVO, to receive your personal data that you have provided us with in a structured, common and machine-readable format or to request that it be transferred to another responsible party, provided that the processing is based on your consent or a contract and that the processing is carried out with the aid of automated procedures;
  • In accordance with Art. 7 para. 3 DSGVO, to revoke your consent, once granted, at any time. As a result, we may no longer continue to process the data that was based on this consent in the future and
  • In accordance with Art. 77 DSGVO complain to a supervisory authority. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at our company headquarters.

3. Right of objection

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 letter e or f DSGVO, you have the right to object, pursuant to Art. 21 DSGVO, to the processing of your personal data if there are reasons for doing so arising from your particular situation or if the objection is directed against direct marketing.

In the former case, we will no longer process your data unless we can prove compelling reasons that outweigh your interests, freedoms and rights or unless our processing serves the assertion, exercise or defence of legal claims.

4. Transfer of data

Your personal data will not be transferred to third parties for purposes other than those listed below.
We only pass on your personal data to third parties if:

  • You have given your explicit consent in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO.
  • The disclosure pursuant to Art. 6 para. 1 sentence 1 letter f DSGVO is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
    In case that there is a legal obligation to pass on the data pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO, and
  • this is legally permissible and, in accordance with Art. 6 Para. 1 S. 1 lit. b DSGVO, necessary for the processing of contractual relationships with you. In addition, our contract processors receive your personal data for processing in accordance with
    your instructions, insofar as this is necessary for the fulfilment of the order. Our contract processors do not have their own right to use your data.

5. Data security

We use the common SSL (Secure Socket Layer) procedure within the website visit in connection with the highest encryption level supported by your browser. Usually this is a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed display of the key or lock symbol or by the use of https in front of the address of our (sub-)website. We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

6. Third countries

Data will only be transferred by us to third countries in accordance with the legal regulations.
As far as we fulfill our contract with you, data will be made available to third parties. Suitable
guarantees according to Art. 46 DSGVO or an appropriateness decision according to Art. 45 DSGVO are not necessary for this.
If you do not consent to the transfer of data, if the transfer of data does not serve the purpose of fulfilling the contract or if the transfer is necessary for the assertion, exercise or defence of legal claims, the data will only be transferred by us if suitable guarantees or a decision of adequacy is available.
A suitable guarantee exists if the EU standard data protection clauses issued by the EU Commission have been concluded.
The legal basis is Art. 45 and 46 DSGVO.

Special data protection information for the data processing processes on the website

1. When visiting the website

When visiting our websites www.synalis.de and www.oktant.eu, your browser will automatically send information to our website’s server. The information is temporarily saved in a so-called logfile. The following information will be collected without your assistance and will be saved until they are deleted automatically:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the accessed file,
  • Website from which the access takes place (referrer URL),
  • the browser used and, if applicable, the operating system of your computer and the name of your access provider.

The above-mentioned data will be processed by us for the following purposes:

  • To ensure a smooth connection of the website,
  • Ensuring a comfortable use of our website,
  • Evaluation of system security and stability and
  • for further administrative purposes.

The legal basis for data processing is Art. 6 Par. 1 S. 1 letter f DSGVO. Our legitimate interest lies in the operation of our website and the associated presentation of our company.

Your data will be deleted as soon as they are no longer required for the stated purposes, after 6 months at the latest.

2. When using our contact form

If you have any questions of any kind, we offer you the opportunity to contact us using a form provided on the website. For this purpose, it is necessary to provide a valid e-mail address, your company and your name so that we know who the inquiry comes from and can answer it. Further information can be provided voluntarily.
The data processing for the purpose of contacting us is carried out in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO on the basis of your voluntarily given consent. The personal data collected by us for the use of the contact form will be automatically deleted after the completion of your request.

If your inquiry is aimed at the conclusion of a contract, Art. 6 para. 1 sentence 1 lit. b) DSGVO serves as the legal basis. In this case, we will store your data for the duration of the statutory retention periods.

3. When registering for our newsletter

If you have expressly consented in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to provide an e-mail address. You can voluntarily provide further information on the form of address, your name and the company so that we can address you personally in the newsletter.
You can unsubscribe at any time, for example using a link at the end of each newsletter.
Alternatively, you are welcome to send your unsubscription request at any time by e-mail to info@synalis.de.
We will store your data until you cancel your subscription.

4. Support

As a customer you have the possibility to contact our support via our website. You can choose between different contact and support options. You can contact our support staff by phone or e-mail. You also have the possibility to create a ticket in your customer portal or use the TeamViewer
Remonte Support. The data transmitted in this process will be processed for the purpose of fulfilling the contract and thus on the basis of Art. 6 para. 1 sentence 1 lit. b DSGVO. We store the data as long as this is necessary for the fulfillment of the contract. Subsequently, we store the data only for the fulfilment of legal retention periods.

5. Cookies, analysis tools, plugins and other third party elements

We use cookies on our site. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar). Cookies do not cause any damage on your terminal device, do not contain viruses, trojans or other malware. Information is stored in the cookie that is related to the specific terminal device used. This does not mean, however, that we obtain direct knowledge of your identity.

The analysis tools we use evaluate the user behaviour of the website visitors and enable us to
optimise the website and adapt marketing measures.

We use plugins and other elements of third parties to integrate the content of these providers into our website.

a) Required first-party cookies

The use of our required first-party cookies serves on the one hand to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted when you leave our site.

In addition, we also use temporary cookies to optimize user-friendliness, which are stored on your end device for a certain defined period of time. The third party cookies, analysis tools, plugins and other elements of third parties listed below and used by us are only used with your express consent and thus on the basis of Art. 6 para. 1 sentence 1 lit. a DSGVO. You can revoke your consent at any time with effect for the future. You can change your settings here. Failure to grant or revoke consent may result in the website not being displayed correctly or in you not being able to use all the functions of the website.

With the third-party cookie analysis tools, plug-ins and other third-party elements that are used, we want to ensure that our website is designed to meet your needs and is continuously optimized. In addition, we use tracking measures to record the use of our website statistically and evaluate it for the purpose of optimizing our offer for you.

(x) Microsoft Dynamics 365 Marketing

We use the Microsoft Dynamics 365 Cloud tool for marketing from the provider Microsoft (Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland), for the implementation of marketing campaigns, for analysis purposes and for targeting customers and potential customers. We use the system to provide landing pages and contact forms and to analyze form activity and click behavior. The components of the system (e.g. forms) integrated in our online offer use so-called cookies, which are stored on the users computer and enable us to analyse the use of the website. In particular, the following information is recorded: client id, geographical location, type of browser, duration of the visit and pages called up. (1) Google Analytics

For the purpose of designing our pages to meet your needs and continuously optimizing them, we use Google Analytics, a web analysis service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter Google). In this context, pseudonymized user profiles are created and cookies (see section 4) are used. The information generated by the cookie about your use of this website such as

  • Browser type/version,
  • operating system used,
  • Referrer URL (the previously visited page),
  • Host name of the accessing computer (IP address),
  • Time of the server request,

are transmitted to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services connected with the use of the website and the Internet for the purposes of market research and the design of these Internet pages in line with requirements. Under no circumstances will your IP address be merged with other Google data. The IP addresses are made anonymous, so that an assignment is not possible (IP-Masking).

In accordance with Art. 49 para. 1 lit. a) DSGVO, the data will be transferred with your consent to the USA as a third country if you have given us your consent after we have informed you of the possible lack or limitation of legal protection and the lower level of data protection in the USA in contrast to the EU.

(2) YouTube

We use social plugins from YouTube LLC (901 Cherry Avenue, San Bruno, CA 94066, USA) a subsidiary of Google LLC on our website. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) to make our company better known.

The plugins are marked with a YouTube logo, for example in the form of a YouTube camera or a Play button.

The integration of these plug-ins by us is done by the so-called two-click method to protect visitors of our website in the best possible way. This means that your personal data (in particular your IP address) is not already transmitted to TouTube when you access the website. Rather, you have to activate the integrated buttons and videos by clicking them. With this click, you give your consent for a connection to the YouTube servers to be established.

Through this integration, YouTube receives the information that your browser has called up the corresponding page of our website, even if you do not have a YouTube profile or are not currently logged in to YouTube.

If you do not want YouTube to associate the information collected via our website directly with your YouTube account, you must log out of YouTube before activating the plugins.

The data are processed in accordance with art. 49 para. 1 lit. a) DSGVO transmitted to the USA as a third country with your consent, if you have given us this after we have informed you about the possibly missing or limited legal protection options and the lower data protection in the USA in contrast to the EU.

(3) Vimeo

We use plugins from Vimeo, Inc. 555 West 18th Street, New York, New York 10011, USA on our website to make our company better known.

The plugins are marked with a Vimeo logo.

The integration of these plug-ins by us is done using the so-called two-click method in order to protect visitors to our website in the best possible way. This means that your personal data (especially your IP address) is not transmitted to Vimeo when you access the website. Rather, you must first activate the integrated Buttons and videos by clicking them. With this click, you give your consent for a connection to be established with the Vimeo servers.

Through this integration, Vimeo receives the information that your browser has called up the corresponding page on our website, even if you do not have a Vimeo profile or are not currently logged in.

This information (including your IP address) is transmitted by your browser directly to a Vimeo server in the USA and stored there. If you are logged in to Vimeo, Vimeo can immediately assign your visit to our website to your account. When you interact with the plug-ins, for example when you start the video, this information is also transmitted directly to a Vimeo server and stored there.

If you do not want Vimeo to immediately assign the data collected via our website to your account, you must log out of Vimeo before activating the plugins.

For the purpose of designing and continuously optimizing our pages according to your needs, we use Crazy Eggs, a web analysis service of Crazy Eggs, Inc. (16220 Ridgeview Lane, La Mirada, CA 90638, USA). The information generated by the cookie about your use of this website

are transmitted to a server of Crazy Egg in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services connected with the use of the website and the Internet for the purposes of market research and the design of these Internet pages in line with requirements.
